Houston Mother Files Wrongful Death Suit Against School and Bus Manufacturer

On September 15, a school bus was hit by another vehicle while driving on a Houston overpass and plummeted to the road below. Inside the bus were 4 students and the bus driver. Tragically, 2 of the students did not survive the horrific accident. Now, the mother of one of the deceased students has filed a wrongful death lawsuit against the Houston Independent School District and International Truck and Engine Corporation, the manufacturer of the school bus, claiming the neglectful acts of both organizations led to the death of her daughter.
In the lawsuit, the plaintiff alleges that the bus driver was speeding and driving too close to the guard rail. She alleges that the bus manufacturer failed to provide a vehicle that was “reasonably crashworthy.” The bus was equipped with lap belts only, making the bus “defective and unreasonably dangerous,” according to the lawsuit. In the crash, the bus was essentially destroyed, which the plaintiff argues proves the vehicle was “weak, inferior, and inadequate.” While neither the bus manufacturer nor the school district will comment on the case, one big change has already occurred as a result of the lawsuit: The Houston Independent School District has since announced that, effective immediately, all new school buses purchased in the district will be equipped with three-point seatbelts, which tests have proven are much safer than a lap belt in crash tests.
